Please take time to read the following terms and conditions carefully. They are important and
form the basis of your contract with Hi-New-York. Please print a copy and keep it for your
Your contract is with Horizon International USA LLC trading as Hi-New-York. Horizon
International USA LLC is a company registered in the state of New York under file number
140113010180/DOS ID 4512532. Our postal address is 630 Fifth Avenue, Suite 2000, New York,
NY 10111, USA. Our email address is firstname.lastname@example.org. We can be contacted by phone on
+1 (212) 574 - 7950.
The language of the contract is English. If the contract is translated into another language, the
English language text shall prevail.
Your Registration Form is submitted to us online or via email. When we receive your
registration request, we issue an invoice, confirmation message and/or email detailing your
registration. It is important that you check the invoice, confirmation message or email carefully
and contact us straightaway if you believe any of the details on it are incorrect.
A contract will exist once we have received your payment. Payments can be made by USD check,
bank transfer, or debit or credit card. Payment is required within 7 working days of registration.
If we do not receive your payment within the 7 working days, we will release the place(s)
reserved. Receipt of payment will be confirmed via email.
We keep copies of both your Registration Form and our confirmation/payment receipt emails
for such periods as are required by US law. They are not, however, available for you to view on
our website and you should ensure that you print copies for your records.
If any provision of the contract is declared void, illegal, or unenforceable, the remainder of the
contract shall be valid and enforceable to the extent permitted by law.
The contract is governed by US law.
The fees on this website are in USD and are subject to change without notice. Fees displayed at
any moment in time supersede all other fees previously displayed or that appear in any
advertisements, printed material, or other places. Once you have made your registration and
paid the course fees, the cost of your course will not be subject to any change. This does not
apply to invoice errors or omissions. Once a registration has been accepted, offers and discounts cannot be applied retrospectively. Unless otherwise stated, prices include any applicable taxes.
If you wish to make any change(s) to your registration, please contact us as soon as you can. We
will try to accommodate your new requirements, but please note that we are unable to accept
change requests (except change of participants) for courses due to start within 2 weeks of the date of the request. If the changed arrangements are more expensive than those originally
booked, you must pay the difference before the change is confirmed. We cannot guarantee that
any alternative course you have in mind will be available and you must not assume that we have
been able to accept your change request until you receive a change confirmation message or
email from us. In addition to any fee difference, the following charges are payable (per person)
in connection with any change:
Period from Change Request to Course Start Charge
More than 4 weeks: None
2-4 weeks: $50
There is no charge for change of participants, which can be made at any time.
You may cancel your registration by written notice to Hi-New-York (Horizon International USA LLC), 630 Fifth Avenue, Suite 2000, New York, NY 10111, USA, or by email to finance@hi-new-
york.com. The amount we will refund you will be the amount you have paid less the registration fee (or, where you have paid a discounted registration fee, the normal registration fee payable
for the course as shown on our website) and the (per person) cancellation charges shown below. The amount you receive back depends on when we receive your cancellation notice and not when you send it. Any bank charges payable in relation to your refund will be payable by you.
Period from Cancellation Request to Course Start Charge
More than 4 weeks: None
2-4 weeks: $250
Less than 2 weeks: 100% of the amount paid
From time to time, we may have to change the details of the course you have booked. It is also
possible that we might have to cancel your course. For example, some courses require a
minimum number of participants to book to enable them to take place and some are dependent
on one particular course leader, who might fall ill.
We divide changes we may have to make to your course into minor and major. Minor changes
include (but may not be limited to) changes to starting and finishing times (but not days),
changes to venues (within 5 miles), changes to instructors, and changes to discussion topics.
Major changes include (but may not be limited to) changes to venues of more than 5 miles. We
will endeavor to tell you about any changes as soon as we know about them.
If we have to make one or more minor changes, you will not be entitled to cancel the course or to receive compensation. If we have to make one or more major changes, however, you may either accept the change(s) or cancel the course and receive a full refund including the registration fee.
Except where a cancellation is due to circumstances beyond our control (see below), if we have
to cancel your course, we will offer a suitable alternative if available or a full refund if we are not able, in our opinion, to offer an alternative that is sufficiently comparable.
If we have to change or cancel your course due to circumstances beyond our control (see below), we regret that we are unable to pay compensation. The maximum compensation we will pay per person per course is that stated above. That is to say, two or more major changes or a major change followed by a cancellation do not give rise to an entitlement to more than one payment.
As group registrations are for customized programs designed to your specifications, certain
conditions and terms will apply in addition to/in lieu of the conditions and terms in this
document as agreed upon by you and Hi-New-York.
When we use the words "circumstances beyond our control", we mean unforeseeable and
unusual circumstances beyond our control, the consequences of which could not be avoided
even if all due care had been exercised by us. These include (but are not limited to) war, threat of war, terrorism, threat of terrorism, riot, civil strife, industrial dispute involving businesses other than ours, public transport failure, natural or nuclear disaster, fire, and adverse weather
conditions including floods.
We accept responsibility for those elements of your course which are under our direct control
and for the acts and/or omissions of our employees. Save as set out below, no liability is
accepted for personal injury or death.
We do accept responsibility for any personal injury or death which results from the negligent (as
the word is understood in US Law) acts or omissions of any employees working on our behalf in
the provision of services or facilities to you and while acting within the scope of their
We cannot be held responsible for any inability to provide all or part of a course, any loss of
enjoyment or any additional expenses due to any circumstances beyond our control (see above).
We can only be liable for the provision of special requests where we have confirmed their
availability in writing.
We shall not be liable in respect of any loss of profits, damage to goodwill or any type of special,
indirect or consequential loss even if such loss was reasonably foreseeable or we have been
advised of the possibility of you incurring the same.
Subject to the above, and excluding liability for death or personal injury (where we do not limit
our liability in financial terms), our liability shall be limited to 2 times the fee paid for the course
in respect to all claims arising out of any contract incorporating these terms of registration.
You must fully advise us when registering of any illness, disabilities, or social or behavioral
problems that a child currently has, or has recently experienced, which might affect him or her
or other participants during the course for which you have registered. We may request written
confirmation from your child's doctor confirming the suitability of the course for your child with
particular reference to such considerations as physical access, successful participation, and
health and safety. We will naturally treat any personal information sensitively and respect
confidentiality. We will not retain any personal information beyond the time we need it.
We are committed to making our courses as accessible to as many people as possible. However,
very occasionally we may not be able to provide the service required, and in these rare cases, we
will refund any fees paid, prorated for any days of the course already attended and subject to
administrative charges incurred, provided all relevant details have been given to us at the time
of registration. If all relevant details have not been provided to us and it is apparent at the start
or becomes apparent during a course that a child has any illness, disabilities, or social or
behavioral problems which in the circumstances cannot be accommodated, we reserve the right
to exclude that child from the course. No refund would be given in this case.
We also reserve the right to exclude any person from any course if his or her behavior is
inappropriate and incompatible with the general enjoyment and wellbeing of others.
You must ensure that you and your child/ren have appropriate travel insurance, including
medical expenses cover, for your trip to the US.
Your and your children's personal property is solely your and their responsibility at all times,
unless any loss or damage is due to our negligence or failure to carry out our responsibilities.
Personal information is requested at the time of registration and subsequently held on computer
or paper. This information is required to allow our employees, agents, sub-contractors and
suppliers to provide your chosen course. By providing us with the information required for
registration, you are deemed to accept the above and to have gained consent from all members
of your party (and where relevant, their parents or guardians) to disclose their details to us.
If you pay by credit or debit card through us and not through our online services, we will delete
your card details immediately after the payment has been successfully completed.
At the time of registration, you may be asked if you wish to receive future mailings from us. If
you do not wish to receive these mailings, please so advise at the time of registration or
alternatively write to Hi-New-York (Horizon International USA LLC), 630 Fifth Avenue, Suite

We want you to enjoy your course. If you have any problems, we want to put them right as
quickly as we can. If there is anything you are not happy with, please bring it to the attention of

If we have not been able to find a satisfactory solution for you during the course, you have 28
days from the last day of the course to contact us and explain your complaint. You can write to
us at Hi-New-York (Horizon International USA LLC), 630 Fifth Avenue, Suite 2000, New York,
NY 10111, USA, email us at email@example.com or phone us on +1 (212) 574 - 7950. Unless
there are exceptional circumstances, we will normally ask that any telephone complaints are
confirmed in writing or by email within 7 working days. We will not normally consider
complaints received or confirmed outside these time periods, except those relating to personal
injury or death. The reason for this is that it is difficult, if not impossible, to investigate
complaints unless we are told about them during or shortly after the end of a course.
